There are multiple efforts underway to investigate the eligibility of President-Elect Barack Hussein Obama to hold the office of President of the United States (POTUS). These fall into several categories:

There are a large number of current ongoing lawsuits and planned lawsuits on this issue.[1][2]


Dismissed Federal lawsuits[]

  • Berg v. Obama et al; Third District Court in Pennsylvania, dismissed October 27 2008 for lack of "standing". Case appealed to the US Supreme Court.[3][4]
  • Berg v. Obama review in US Supreme court. Dismissed without comment January 21, 2009[5].
  • Berg emergency injunction to stay the general election; filed in the US Supreme Court; dismissed November 3, 2008.[6]
  • "NEW JERSEY VOTER VS. OBAMA AND McCAIN ON "NATURAL BORN CITIZEN" STATUS" by retired lawyer and former NJ Secretary of State against current NJ Secretary of State for not properly vetting Obama; appealed to US Supreme Court, and was dismissed December 8, 2008.[7][8]
  • Cort Wrotnowski of Connecticut, filed in US Supreme Court; Marked as "denied" under "pending cases" on December 15, 2008[9][10]
  • Berg v. Obama in US Federal Appeals court
  • Berg v. Obama in DC District court; suing for fraud and return of campaign funds and Senate salary.
  • Berg v. Obama in DC District court; sealed False Claims Act suit.

  • Twenty four potential electors suing Obama.[33]
  • Lindsey Springer of Oklahoma is suing at least 16 secretaries of state in separate lawsuits for their choice of electors who intend to vote for ineligible candidates as well as enjoining the secretaries of state in each state from certifying the results of the elector voting if they have voted for an ineligible candidate.
  • A planned lawsuit in New York State if Obama does not respond to a national ad containing an open letter to Obama.
